Jesus said bless those who persecute and lie about you. We were wrongfully arrested and lied about by LCPD when we were out preaching Christ. We still bless and forgive them and hope they repent. See their internal investigation below refuted and video that proves we are innocent, all for the Lord's glory. God be praised Tupos with Aman Dontperish.com The following is a detailed refuting of Andrew's investigation of our unlawful arrest of criminal trespass on Dec 15, 2024. Note: At the bottom of this post are 2 links regarding this case before this report and shortly after our arrest. In the screen shot below you will see that in James request for investigation, he noted that LCPD supervisor Aymond (on video) tells us we are fine to stand there and preach without the amp. James politely asked her to verify the amp law (because it's very vague). Once she walked away, the amp was never mentioned again. Fact: Andrew, himself, in the investigation, never even comments on this important fact about their supervisors words, even though it's on video from our body cams as evidence. At about 7 seconds Aymond says we're more than welcome to preach there without the amp. We were never on church property at any time! Andrews investigation fails to note any information about the large tattooed man that offered to write a ticket if we both left the area. The officer got frustrated and closed the doors on us and hauled us to jail. That was the 2nd time our first amendment rights were denied by LCPD. Why wasn't he interviewed and where was his body cam information, was that lost also? (We learned that both arresting officers body cams were not working that day. How interesting.) Sgt. Aymond states she would have allowed us to stay if the amp is turned off and then cites the amp law as if we were in violation of it. See video below where she says the amp would have been fine on the sidewalk. Note: Andrew's investigation report never mentions any of this confusion. Why were we ticketed for disturbing the police if the amp would have been okay to use across the street? The amp law is very vague, doesn't cover small hand held amps and we believe we may not have broken the law using it. (No one took a decibel reading.) At minute about 1:50 you can hear Sgt Aymond say "the sidewalk would have been fine, the amplifier would have been fine". In the screen shot below, Sgt. Aymond insinuates / possibly slanders that we are dangerous by her quote about bullets not stopping our preaching. Our video clearly says exactly what was stated and we weren't violent in any way. Fact: Andrews investigation failed to verify what we actually said, it's on video. At about second 35 you hear the exact quote about bullets / guns that Sgt Aymond twisted and falsely stated. Note that Sgt. Aymond was standing there close enough to hear the entire context. Sgt Aymond falsely accuses us of being on Glad Tidings property when we can clearly see that we were on city easement property the entire time. This screenshot (below) from Andrew's report / city zoning man shows that we were never even close to the church property line as we stayed near the curb the entire time. We have 2 body cams with full video of our entire visit there and they prove we never set foot close to the property line and were always by the curb or on it. The red dots on the picture below show the only areas we were the whole time during our visit before our unlawful arrest. (The red dot by the 25' mark is where we were falsely arrested, which is city property.) Note: Andrew never asked us for this proof to refute their testimony of us being on their property nor were we ever asked for more details. Below are videos proving where we were standing the entire time during this engagement proving that Sgt. Aymond falsely stated about us being on their property. The officers clearly did not know about the city zoning area and I tried to tell them all along and they rejected it. In the screenshot below Sgt. Aymond falsely states / lies that James refused to speak to Linzi but you can see in the video James offering her a gospel card of which she walked out to the curb (where we were standing) and took a gospel card. At minute 1:13 you see Linzi receiving the gospel card and prior to that you can hear the calm conversation that Debbie has with her, even stating that we would be happy to correspond with her via email and James engaged with her as well. Sgt. Aymond conveniently leaves out this calm portion of conversation with Linzi. In the 2 screenshot below, you see, once again, Sgt. Aymond makes a false statement that we were on Glad Tidings property. Officer Wolfe tries to tell us to leave and James stepped into the street, trying to convince him that we were on city property, asking many times for free speech rights and stop him from unlawfully arresting us and trampling our first amendment rights. From the screen capture of the lot lines (above) we were clearly on city property and both Sgt Aymond and officer Wolfe were in the wrong for arresting us. In the picture and video below you can see Wolfe handcuffing James as he stands in the city streets and Debbie had stepped off the curb into the street as soon as office Wolfe mentioned trespass. That was the first and only time trespass was mentioned. Both of these officers, Sgt. Aymond and officer Wolfe acted quickly to unlawfully arrested us / trample our free speech rights. Since they both were working as security guards for Glad Tidings church, this looks like retaliatory free speech infringement. They clearly wanted us silenced and gone from the area. At about minute 2:11 you see James feet on the curb when officer Wolfe grabs his arm to arrest him. At second 6 see Debbie on the curb and second 36 she is arrested in the street. In the screen shot below the van is stated as being illegally parked. Apparently if the amp had been turned off we could have stayed there per Sgt. Aymond's testimony but nobody mentioned our van until we were arrested. Our van had gospel signs on it, which we believe is another evidence of retaliatory first amendment infringement. There are 3 reasons our van was unlawfully impounded. 1) We were illegally arrested by Sgt Aymond and officer Wolfe for trespass while on city property, as the facts prove. 2) We were never ticketed nor did anyone mention it until we were in handcuffs being illegally arrested. It costs us a total of $700 to get it back and since it was our house (and the officers knew this) we had to get a motel room because the towing company was closed (as officers know). 3) Days early Debbie was given permission by Sgt Aymond (twice) that we were legal to park on that street. Fact, Andrews report fails to mention this. (See the email correspondence from Debbie with Sgt Aymond below. See our intent on keeping the law before we even arrived there.) In the screenshot below Sgt. Aymond makes another false statement as no tickets were ever presented to us to sign at any time. As mentioned above, a large tattooed officer did offer us a ticket if we left the area, we both asked to go to the public sidewalk for our free speech rights and then they hauled us off to jail. (This all should be on the body cam of the transporting officer for Debbie and of the officer-with tattoes.) Fact: None of this is on Andrews report. Note: At no time were we ever offered a free speech place as they trampled our first amendment rights. We also want to note that neither police units cared enough about us to seat belt us in as we drove to the police station. That is being investigated separately per Andrew's report. The screenshot below from officer Wolfe, who has retained an attorney for his defense, proves what we've been saying about retaliatory first amendment infringement. Did officer Wolfe and Sgt Aymond had motive to silence us and have us removed as security guards for Glad Tidings church? In the screenshot below, officer Wolfe falsely states that we are standing in the grass during our conversation with Linzi yet our videos prove otherwise as we've shown above. In the screenshot below, officer Wolfe infers that we did not have a conversation with Linzi but you can clearly see (on the video below) the calm conversation and her receiving a gospel card while we stood on the curb. At no time did anyone at Glad Tidings tell us to leave even though we weren't on their property. In the video below officer Wolfe clearly heard James request (many times) to have first amendment rights in the grassy / curb easement area that the city owns. James had no intent to preach from the street. Officer Wolfe acted quickly (within 30 seconds) to falsely arrest both James and Debbie while on public city property (as the zoning man has proven). Keep in mind that once again the screenshot of the property lot lines prove Sgt. Aymond and officer Wolfe were wrong in in arresting us on this day. Even if we were going to preach from the street, the charge of criminal trespass is unlawful. Fact: Andrews investigation fails to clearly state what is the truth, even from his own zoning man. Officer Wolfe makes the false claim that James stepped onto Glad Tidings property but clearly, per their zoning man, that is city property. We believe their amp law doesn't cover small hand held devices and no one took a decibel reading. We were hundreds of feet from the building and not interrupting anything because their service had not started. Loud cars driving by made more noise than we did. In the screenshot below we see how officer Wolfe's statements do not line up with Sgt. Aymond's in that he immediately contacted transport officers and a tow truck yet Sgt. Aymond (in the second screenshot below) stated that tickets were being written. Once again, why was our van not an issue, where it was parked, until we were unlawfully arrested. Was this retaliatory infringement of our first amendment rights as they were both security guards for Glad Tidings? Fact: Andrew's report never mentions this discrepancy as someone is stating false claims. In the screenshot below, Linzi (from GT church) falsely claims that the only time we were on the curb was when officer Wolfe approached when clearly the videos show us being on the curb while talking to her. Again, we have 2 full body cams that prove we were never far from the curb and on city property all the time. Linzi also was not telling the truth. Note: Andrew's report doesn't state this discrepancy. In the screenshot below, Linzi says they consider that as Glad Tidings property but she is wrong as the zoning man said it's not Glad Tidings property as per the screenshot above from Andrew's report. At no time were we ever on Glad Tidings property, making this an illegal arrest and false accusation. In the screenshot below, Linzi claims, three times, that we were 'combative'. Linzi falsely accuses us of being combative yet see the video evidence below of our entire encounter with her, including our conversation, her taking a gospel card and our invitation to email us all in a calm manner. The fact is, officer Wolfe walked up and ended the conversation. In the screenshot below, Andrew asks Linzi what she thinks is their private property. Fact: Andrew fails to document that Linzi, Sgt. Aymond and officer Wolfe were all wrong based on the screenshot above from their zoning man, Robert. How can a complete investigation from the police department have such shoddy work? In the screenshot below, Andrew describes Sgt. Aymond claiming a violation of the amplifier. Their code specifically talks about a building and a moving vehicle using an amplified device. It also mentions the hours of 7 am to 10 pm, not exceeding 85 decibels. Andrew clearly sees on video there was no decibel reading nor did he ask for any information about it. It must be noted once again, we are hundreds of feet from the building standing on the curb. At no time were we on Glad Tidings property. In the screenshot below, Andrew claims that James refused to comply to their ordinance but James, in fact, asked them to clarify because it's confusing and doubtful that he was breaking it. We can prove that by the video above where Sgt. Aymond said it would have been okay to use the amp on the sidewalk. No police officers offered us free speech on the sidewalk. Here Andrew crosses the line! He makes the statement that James chastises Linzi's practices and he seems to have issues with our calm biblical rebuke of her. Andrew is using opinion and his preference, clearly not being impartial in this investigation. Does he not know we have free speech to say what must be said when it comes to the truth of God's word. He's way out of line here! Andrew said James was abrasive to officer Wolfe's commands but the fact is they were not lawful commands per Andrews investigation of the lot line from their zoning man. We were on city property the entire time and have free speech in that area or at least it was not criminal trespass. Andrew needs to be without bias in his investigations. Police always say 'ignorance of the law is no excuse' we heard it that day from officer Wolfe see the video below. Officer Wolfe needs to learn it's unlawful to arrest people for criminal trespass while on city property. We want to know what is their excuse for Andrew's, Linzi's, officer Wolfe's and Sgt Aymond's ignorance of the city property that James tried to tell them about before they illegally arrested us and trampled our free speech rights. Also the ignorance from the large tattooed officer that is sworn to uphold the constitution but denied us from going to preach on the public sidewalk. Note: Andrew's report mentions nothing about this important matter. In the screenshot below, Andrew says James continued to 'argue' with the officers. All James did was defend his right to have first amendment speech on city property. We were right all along per Andrew's investigation and Robert, the zoning man. We would like to know why Andrew doesn't clearly state this in his own words on this investigation, is he biased? Those trees are close to the city property line and we were never anywhere near them as our videos show. In the screenshot below, Andrew makes statements that he clearly should not. Once again, per his own investigation, we were on city property the entire time per their zoning man Robert. Andrew is alleging that James lied but that's not true. He needs to repent of his shoddy investigation practices. We would like to know if Andrew reads his own investigative report? From his zoning man we were never on Glad Tidings property. Andrew claims that we were 'arguing' with the officers when in fact we were correct, they were not giving us lawful orders as we were not on private property and we were wrongly arrested. It's easy to see our first amendment rights were trampled several times this day. In the screenshot below, Andrew needs to follow his own report that clearly shows that grass is city property per their zoning man Robert. See the screen capture above. Andrew is showing his partiality in many ways and this must be called out for truth's sake. The following picture is from Andrew's investigation correspondence with Robert their zoning man. We are not sure why he has that area circled in red because it's not the area in question at all. The blue line marks where we stood the entire time and where we were unlawfully arrested on city property. The red dot by the 25' mark is where we were arrested in the screenshot below. Fact: this information alone destroys their arrest for criminal trespass which Andrew does not make very clear in his statements. In the screenshot below, LCPD is shown to be so incompetent and callous that they neglected to safely seatbelt James and Debbie after the unlawful arrest on the way to unlawfully book them. Another investigation is being done, proving more incompetence with LCPD. (This would be the third investigation needed from this instance. No body cam footage, not seat belting us in and officers unlawfully arresting us.) In the screenshot below Andrew admits that both arresting officers failed to have body cam footage. Why is this? Fact: Andrew failed to contact us to see our body cam footage of our entire visit outside Glad Tidings Church. Our entire body cam footage shows what James claimed all along and Robert the zoning man proved, we were never on Glad Tidings private property. We were unlawfully arrested and our free speech was taken away. In the screenshot below Andrew says it was problematic because he didn't have footage, but once again he never asked to interview us or get our entire body cam footage. How is this a complete, unbiased investigation? Notice: Again, they had to do another investigation on why there were no body cams on the arresting officers. We heard from a reliable source that this is a common problem in the LCPD. We wonder what they are hiding? In the screenshot below, Andrew states that it (whether we were on public or private property) could not be initially determined because of lack of body cam footage but once again, he never asked for our complete footage that shows we were never far from the curb which is city property. If he would add our body cam footage to Robert's information, Andrew could clearly conclude, at the time of arrest for trespass (or any other time) see we were not on Glad Tidings property. How can he not put these facts together and get to the truth? In the screenshot below, Andrew summarizes the false claims from Linzi that we were on private property when evidence shows we were by or on the curb the entire time. We were never once offered or asked to go to the sidewalk. Watch the video below of our entire engagement with Linzi, who is not telling the truth. This video evidence proves we were on city property, per Robert the zoning man, when approached about trespassing. Why can't Andrew clearly determine this? In the screenshot below, Andrew, once again mentions the zoning department which clearly shows we weren't on private property. We will state this fact again. Andrew never asked to see our entire body cam footage of our entire time there nor did he personally interview us. Why not? In the screenshot below, Andrew makes excuses for the officers unlawfully arresting us on city property. Once again 'ignorance of the law or facts' is not an excuse and they must be held responsible for denying our first amendment rights that day in what appears to be potential retaliation because they were security guards for Glad Tidings Church. In the screenshot below, Andrew fails to mention that the grassy area we were standing on the entire time, then when arrested, was proven to be city property by Robert the zoning man. Does Andrew consider respectful manner to be: 1) Unlawful arrest without checking the facts. 2) Lifting up a woman's blouse in front of men. 3) Officer Wolfe was squeezing Debbie's arm after she's handcuffed and not resisting see the video below. Andrew never mentions this. 4) Officers making false claims and making James look like he's violent, by their words. (Are false statements on an investigation a crime?) 5) Not safely securing us with seat belts after being illegally arrested. 6) Towing our van unlawfully after being unjustly arrested for criminal trespass on city property. As street preachers we deal with police, almost daily and have never been arrested or ticketed. LCPD is the absolute, most unjust group of people we have ever seen in law enforcement. In the screenshot below, Andrew defends the towing of our van. Not one police officer mentioned our van until we were in handcuffs. Why is this? In the screenshot below, Andrew mentions about our van being illegally parked. Two points need to be noted. 1) Days ahead Sgt. Aymond gave permission to park on this street. See the screenshots of the email conversation above. Andrew's report never mentions that, why is that? 2) Why were we not ticketed if it was illegally parked? Again there was no issue until we were unlawfully arrested. It must be noted that our van was covered with gospel signs and both officer Wolfe and Sgt. Aymond were acting as security guards for Glad Tidings Church. Was this a retaliatory first amendment rights infringement? In the screenshot below, what Andrew says is very troubling because they have no evidence to show we were on their private property yet we have the entire body cam footage showing we were always on city property near the curb. Andrew never asked to see our body cam footage, that's troubling! Note: Doesn't Andrew know that it's not considered trespass until you're told to leave? The very first time trespass is mentioned is a minute or so after we were told we were okay to stand there by Sgt. Aymond. Again, Andrews report never mentions that fact. At the time officer Wolfe stated we were /are trespassing, we were both on the curb or in the city street / on city property. How does Andrew miss this fact when Robert the zoning man makes it clear that it is NOT Glad Tidings property but in fact city property. Is he that biased? In the screenshot below, Andrew says that this arrest was made in accordance of facts from the officers at that time. Once again LCPD officers told us that day 'ignorance of the law / facts' is no excuse. What Andrew's and LCPD for this unlawful arrest? Note: Andrew said the officers didn't violate any policy. If the facts of this refuting and them arresting two peaceful citizens, on city property and denying their first amendment rights several times, doesn't violate LCPD policy, they need new policies! In the screenshot below, Andrew states that we were in violation of 'numerous' city ordinances including the use of an amplified device. If that's the case, why did officer Aymond (after our arrest) state that the amplifier would have been 'fine' on the sidewalk? (Once again, we were never offered to go to the sidewalk, in fact it was denied after we were arrested, trampling our first amendment rights.) At minute about 1:50 you can hear Sgt Aymond say "the sidewalk would have been fine, the amplifier would have been fine". (Andrew's report fails to mention this.) In the screenshot below, Andrew finishes his investigation by saying the findings are not sustained regarding police misconduct. Sadly Andrew did not do a thorough investigation, looking at all the evidence including our full body cam of our visit there. He was only concerned about police conduct by procedures. The fact is LCPD officers acted, on that day (they were Glad Tidings security guards) to trample our first amendment rights by not investigating the facts about city property that we were clearly on, the entire time. Once again in a court of law, ignorance of the law and facts is not an excuse and if you watched all the videos we've offered, you see James trying to entreat the officers to protect our first amendment rights and insisted we were not on private property. (At one point, on video, James said he was not on public property but it's clear he meant not private property.) In our opinion, Andrews report does one good thing, it documents that what James said is city property (from the zoning man Robert), is city property. We have full video of our visit to show we never left the area of the curb. In conclusion, we find most of this report is full of false information and overlooked facts. Clearly, anyone with righteous judgement can conclude we were peacefully on city property the entire time and we were unlawfully criminally trespassed. Also, our first amendment rights were denied several times and our van illegally impounded. We love and forgive everyone involved and hope they repent.
